What HAUS Does
HAUS acts as the Owner’s booking agent and guest concierge. Our role covers: obtaining and managing all NSW Short-Term Rental Accommodation (STRA) registrations on behalf of the Owner — this is performed as part of the property set-up and platform launch process, as no platform listing can proceed without a valid STRA registration number; listing and managing the Property on agreed platforms; setting and adjusting pricing in consultation with the Owner; handling all guest enquiries and communications; coordinating cleaning and changeovers; responding to guest requests during a stay; and providing the Owner with regular booking and income updates.
HAUS acts as booking agent and concierge only. We are not the property owner, occupier, or on-site operator and have no authority over or physical presence at the property.
What HAUS Does Not Do
The following are outside the scope of this agreement and remain the sole responsibility of the Owner: physical maintenance or repairs, ensuring the property meets safety standards and planning requirements, arranging or holding insurance, on-site supervision or emergency response, and decisions regarding capital works or renovations.
HAUS may from time to time offer suggestions regarding the property. These are advisory only. The Owner is not obliged to act on them, and HAUS accepts no responsibility for the outcome of any such recommendation.
Owner Responsibilities
The Owner agrees to ensure the property is safe, clean, and fit for guests at all times; comply with all NSW short-term rental accommodation laws applicable to the property (noting that STRA registration is obtained and managed by HAUS); hold current public liability insurance appropriate for short-term rental use (minimum $20 million recommended); notify HAUS promptly of anything affecting guest safety or the listing; and make decisions in a timely manner when required.
The Owner acknowledges they are solely responsible for what occurs at the property. HAUS cannot direct, control, or supervise on-site activity. The safety and lawful operation of the property is the Owner’s responsibility at all times.
Fees & Payment
Management commission: 16.5% of gross booking revenue (before GST). Platform fees are deducted by platforms prior to remittance. Cleaning and contractor costs are passed through to the Owner at cost. All direct booking and other payments are made directly to the nominated Owner’s bank account by direct transfer; the Owner is invoiced for all services agreed upon and provided.
Limitation of Liability
HAUS is not liable for any damage, loss, or injury occurring at the property; guest behaviour before, during, or after a stay; decisions or fee changes made by Airbnb, VRBO, or any other platform; loss of income due to cancellations or market conditions; or any consequence arising from the Owner’s failure to meet their legal, safety, or insurance obligations.
The Owner indemnifies HAUS against any claim, loss, or cost arising from the Owner’s failure to maintain the property in a safe and lawful condition, or from any act or omission of the Owner, guests, or any other person at the property.
Term & Termination
Either party may terminate this agreement with 30 days’ written notice. On termination, HAUS will return all booking records, guest communications, and platform access to the Owner within 14 days. All confirmed bookings made prior to notice of termination will be honoured unless otherwise agreed in writing.
At termination, the Owner may choose one of two options:
Option 1 — Transfer to a new agency: HAUS will transfer all listings, guest communications, and booking records to the incoming agency. A transfer fee of 10% commission applies to any bookings already confirmed at the time of transfer. Where the incoming agency is introduced by HAUS, a referral fee of 6% of gross booking revenue for the first 12 months applies, payable by the incoming agency.
Option 2 — Owner self-manages: HAUS will provide a full handover pack including login credentials, listing content, and booking history. No transfer fee applies.
General
This agreement is governed by the laws of New South Wales. Any changes must be agreed in writing by both parties. This agreement represents the entire understanding between the parties regarding the management of the property.
